There’s Still Time to Register – “What Every Librarian Needs to Know About the USA PATRIOT Act & Related Anti-Terrorism Measures”
The Special Libraries Association has joined with AALL, ALA, MLA, & ARL in sponsoring a satellite teleconference that provides libraries and their governing institutions with an analysis of the implications of the recent anti-terrorism measures, including the USA PATRIOT Act, the Attorney General's Guidelines expanding the investigative powers of the FBI, and the Homeland Security Act. The teleconference is scheduled for December 11, 2002 from 12:00 - 3:00 p.m. ET. Go to http://www.sla.org/content/memberservice/communication/safeguard.cfm for complete details and registration information. To locate a site in your area that is accepting guests, go to: http://db.arl.org/patriot/fmpro.

Network Monitoring and P2P
On November 6, 2002, EPIC (Electronic Privacy Information Center) sent out a letter on network monitoring of peer-to-peer (P2P) usage in the higher education community. EPIC has advised colleges and universities not to take on any obligation to monitor P2P usage, as such monitoring can chill free speech, impinge upon academic freedom, and invade privacy. The full text of the letter is online at: http://www.epic.org/privacy/student/p2pletter.html

TEACH Act Becomes Law
On November 2, 2002, the "Technology, Education and Copyright Harmonization Act" (the TEACH Act), part of the larger Justice Reauthorization legislation (H.R. 2215), was signed into law by President Bush. The TEACH Act updates the distance education provisions of the Copyright Act to meet the challenges of the networked environment. Previously, the law included a statutory exception for the benefit of distance education, but because it was enacted in 1976, it failed to meet modern needs. The TEACH Act redefines the terms and conditions on which accredited, nonprofit educational institutions throughout the U.S. may use copyright protected materials in distance education--including on websites and by other digital means--without permission from the copyright owner and without payment of royalties. http://www.ala.org/washoff/teach.html

Who are the Candidates for Security Jobs?
With the law to create a Homeland Security Department now on the books, high-tech lobbyists have begun speculating about who will be chosen to fill key technology leadership positions within the new Cabinet-level agency. http://www.govexec.com/dailyfed/1102/112702td2.htm
  _____

Legal Scholars and Library Groups Seek Clarification on Software Licenses
Law professors and academic-library groups are asking a federal appeals court here to modify a recent ruling to make it clear that established copyright provisions, like fair use, sometimes trump software-licensing agreements that would otherwise narrow consumers' rights.

Greeting Card Virus Licensed to Spread
Think carefully before opening an electronic greeting card. The FriendGreetings electronic greeting card has all the hallmarks of a mass-mailing computer virus. The e-mail misleads a victim into downloading an application--ostensibly to view a Web card--and then sends itself to every e-mail address in the victim's Outlook contacts file. The catch is that you must do a license agreement--without the license agreement, the program would be considered a virus, but with the code wrapped in what could be a prosecution-proof vest, virus might not be the proper term. http://news.com.com/2102-1001-965570.html
